  • Which-Marina.com is administered by "The Yacht Harbour Association" (TYHA).

  • Information on Berths and Marinas is supplied by the Marina Companies subscribing to the Which-Marina.com service, and is correct as at the time it was received and added to Which-Marina.com.

  • TYHA cannot be held responsible for any incorrect information provided by the Marina Companies listing on Which-Marina.com.

  • TYHA cannot be held responsible for any information provided by the Marina Companies which may be out of date.

  • TYHA cannot be held responsible for any non reply from any Marina Company to e-mail sent via the Which-Marina.com Website.

  • TYHA is happy to assist any Boat Owner with their search for a suitable Berth or Marina on a best endeavours basis.

  • With regards to links listed on Which-Marina.com, TYHA accepts no responsibility or liability in respect of any material displayed on any third party websites, which are not under the control of TYHA.

  • We will do our utmost to ensure that the availability of the Which-Marina.com website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

  • You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged, or impaired in any way.

  • You understand that you, and not Which-Marina.com, are responsible for all electronic communications and content sent from your computer to us, and on to any third party Marina Companies, and you must use the website for lawful purposes only.

  • You must not use the website for any of the following:

  • For fraudulent purposes, or in connection with a criminal offence or other unlawful activity.

  • To send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam" .

  • To cause annoyance, inconvenience or needless anxiety .

  • Which-Marina.com will take appropriate steps to prevent the sending of spam emails to third parties listed on the website, but it access no liability for any spam email sent via this site where the spammer has broken the terms and conditions laid out above in relation to the use of this site.

TYHA Complaints Procedure

  • Complaints are reviewed by the TYHA General Manager in the first instance, following the procedure outlined in this clause.

  • Complaints are requested in writing and are to be directed to the TYHA General Manager at The Yacht Harbour Association Registered Office.

  • TYHA will endeavour to acknowledge all Complaints within a maximum of 14 working days.

  • Upon receipt, the TYHA General Manager will review the complaint and attempt to negotiate between the parties in order to reach a satisfactory conclusion within a reasonable time.

  • Review of the complaint:

  • If, in the course of dealing with the complaint, it is considered by TYHA that the Marina is in breach the TYHA Code of Practice, or in the case of a TYHA member their conditions of membership, TYHA will inform the member of the breach and ask them to rectify it.

  • However, if the breach is considered to be serious, it will be forwarded to the TYHA Chairman who may at his discretion put the matter before the TYHA Council, being the statutory directors and strategic forum for the business to investigate further with a view to taking appropriate action.

  • This decision will be final and will not be subject to further review by TYHA.
